Legal Information
1. Scope of Application
These provisions apply to all services provided by SHUTTLE, regardless of how the service is booked or delivered.
This includes, but is not limited to, airport transfers, private chauffeur services, point-to-point transportation, group and event transport, bus services, guided experiences, UTV tours, and any other custom or coordinated mobility solutions.
These provisions form the general legal framework governing the relationship between SHUTTLE and the customer and apply unless supplemented or replaced by service-specific Terms & Conditions or written agreements.
2. Operational Conditions
SHUTTLE operates in Arctic environments where conditions can change rapidly and without notice.
All services are subject to external factors including, but not limited to:
- Weather conditions
- Road, terrain, and infrastructure conditions
- Flight schedules, delays, and cancellations
- Operational and logistical constraints
SHUTTLE reserves the right, at its sole discretion, to adjust routes, timing, vehicles, or execution of services in order to ensure safety, efficiency, and operational feasibility.
Customers acknowledge that exact timing and execution cannot always be guaranteed under such conditions.
3. Safety and Instructions
Safety is a core operational principle of SHUTTLE.
All customers and passengers are required to:
- Follow all instructions given by drivers, guides, and staff
- Use provided safety equipment correctly
- Act in a responsible and cooperative manner
Drivers and staff are authorized to make real-time decisions to ensure safety.
Failure to comply with safety instructions, disruptive behavior, or actions that may endanger others may result in immediate termination of the service without refund or compensation.
4. High-Risk Activities
Certain services offered by SHUTTLE involve inherent risks due to the nature of the environment and activity.
This includes, but is not limited to, UTV tours, off-road driving, and operations in remote or natural terrain.
By participating, customers acknowledge and accept that:
- Such activities involve risks that cannot be fully eliminated
- Terrain and conditions may be unpredictable
- Participation is voluntary and at their own risk
Customers are responsible for ensuring they are physically and mentally fit to participate. Additional waivers or safety requirements may apply.
5. Delays and External Factors
SHUTTLE shall not be held liable for delays, changes, or interruptions caused by circumstances beyond reasonable control.
This includes, but is not limited to:
- Weather and environmental conditions
- Flight delays or cancellations
- Traffic, road closures, or infrastructure limitations
- Mechanical issues despite proper maintenance
- Government regulations or restrictions
While SHUTTLE will make reasonable efforts to adapt and minimize disruption, no guarantees can be made regarding timing under such conditions.
6. Limitation of Liability
To the fullest extent permitted by applicable law, SHUTTLE’s liability is limited.
SHUTTLE shall not be liable for:
- Indirect or consequential losses
- Loss of business, revenue, or opportunity
- Delays or disruptions beyond its control
- Customer negligence or misuse of services
Where liability cannot legally be excluded, it shall be limited to the total amount paid by the customer for the specific service in question.
7. Insurance
All SHUTTLE operations are insured in accordance with applicable laws and industry standards.
Insurance coverage generally includes:
- Vehicles
- Passengers
- Third-party liability
However, all coverage is subject to the specific terms, conditions, exclusions, and limitations of the insurance provider.
Customers are responsible for ensuring that they have adequate personal insurance, including travel insurance and coverage for personal belongings.
8. Customer Responsibilities
Customers are responsible for:
- Providing accurate and complete booking information
- Being present and ready at agreed times and locations
- Following all instructions provided by SHUTTLE staff
- Complying with applicable laws and regulations
Customers may be held financially responsible for any damage, loss, or disruption caused by their actions or negligence.
9. Personal Belongings
All personal belongings are carried at the customer’s own risk.
SHUTTLE accepts no responsibility or liability for:
- Loss or theft of personal items
- Damage to personal property
- Items left behind in vehicles or during services
Customers are encouraged to keep track of their belongings at all times.
10. Third-Party Services
In cases where SHUTTLE coordinates or facilitates services provided by third parties, such services may be subject to separate terms and conditions.
SHUTTLE acts as an intermediary or coordinator where applicable and shall not be held liable for the performance, actions, or omissions of third-party providers.
Any claims related to third-party services must be directed to the relevant provider.
11. Force Majeure
SHUTTLE shall not be considered in breach of its obligations if performance is prevented, delayed, or made impractical due to events beyond reasonable control.
Such events include, but are not limited to:
- Natural events and extreme weather
- Government actions or restrictions
- Strikes or labor disputes
- Failures in infrastructure, transport systems, or utilities
In such cases, services may be modified, postponed, or cancelled without liability.
12. Right of Refusal
SHUTTLE reserves the right to refuse or discontinue service to any individual who:
- Appears intoxicated or under the influence of substances
- Behaves in a threatening, unsafe, or inappropriate manner
- Fails to comply with instructions or safety requirements
Such decisions are made at the sole discretion of SHUTTLE staff and are final.
13. Non-Discrimination
SHUTTLE is committed to providing services without discrimination.
Services are offered regardless of race, nationality, gender, religion, age, or disability, in accordance with applicable laws.
Any behavior violating this principle may result in removal from the service.
14. Amendments
SHUTTLE reserves the right to update, modify, or replace these provisions at any time without prior notice.
The version applicable is the one in effect at the time of booking or service use.
15. Governing Law
These provisions are governed by the applicable laws of Greenland.
Any disputes arising in connection with SHUTTLE services shall be subject to the jurisdiction of the courts in Greenland.
16. Final Provisions
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These provisions constitute the general legal foundation governing all services provided by SHUTTLE.
